ARTICLE 1 – DEFINITIONS

In these terms and conditions, the following definitions apply:

Withdrawal period: The period during which the consumer may exercise the right of withdrawal.
Consumer: Any natural person who is not acting for purposes related to their trade, business, craft, or profession and who concludes a distance contract with the seller.
Ongoing performance contract: A distance contract relating to a series of products and/or services, with delivery and/or purchase obligations spread over time.
Durable medium: Any means that enables the consumer or the seller to store information addressed to them in a way that allows access and reproduction of that information unchanged in the future.
Right of withdrawal: The option for the consumer to cancel a distance contract during the withdrawal period.
Professional / Seller: The entity offering products and/or services at a distance to consumers.
Distance contract: A contract concluded under an organized distance selling scheme without simultaneous physical presence of the parties, using only distance communication.
Means of distance communication: Any means which may be used to conclude a contract without the simultaneous presence of the parties.
Terms and Conditions: These General Terms & Conditions of Sale of the seller.

ARTICLE 3 – SCOPE

These Terms & Conditions apply to every offer from Tiamo Jewellery and to every distance sales contract concluded between Tiamo Jewellery and the consumer.

Before concluding a distance contract, the consumer will be provided with these Terms & Conditions or informed where they can be accessed. A copy will be provided free of charge upon request.

If the contract is concluded electronically, the Terms & Conditions will be provided on a durable medium for later reference.

If special conditions apply to a specific product or service, they supplement these Terms & Conditions. In case of conflict, the most favorable provision for the consumer prevails.

Invalid provisions do not affect the validity of the remaining contract. Any invalid provision shall be replaced by a valid one consistent with its original intent.

ARTICLE 4 – THE OFFER

If an offer is subject to a limited duration or specific conditions, this will be clearly stated.

The offer is non-binding. Tiamo Jewellery reserves the right to modify the offer at any time.

Product descriptions are as accurate as possible. Images reflect the products faithfully.
Obvious errors do not bind the seller.

The offer includes clear information regarding:

• Price (excluding customs duties and import VAT)

• Shipping costs

• How the contract is concluded

• Whether a right of withdrawal applies

• Payment, delivery, and performance terms

• Offer validity period

• Archiving access to the contract

ARTICLE 5 – THE CONTRACT

The contract is concluded when the consumer accepts the offer and meets the associated conditions.

In the case of electronic acceptance, Tiamo Jewellery will confirm receipt immediately. Without confirmation, the consumer may cancel the contract.

Tiamo Jewellery ensures secure electronic transactions.

Credit and fraud checks may be carried out. Orders may be refused if doubts arise.

After conclusion, the consumer receives:

• Contact details for complaints

• Withdrawal instructions

• Warranty and after-sales conditions

• Conditions for ongoing performance contracts (if applicable)

The contract is subject to product availability.

ARTICLE 6 – RIGHT OF WITHDRAWAL

The consumer may cancel the order within 30 days after receipt, without giving reasons.

During this period, the product may only be handled as necessary to establish its nature and characteristics.

Withdrawal must be declared within 14 days by written notice or email.
The consumer then has 14 days to return the goods.

After expiry of the withdrawal period, the order becomes final.

ARTICLE 7 – COSTS IN CASE OF WITHDRAWAL

Return shipping costs are borne by the consumer.

Refunds are issued within 14 days after receipt of the returned goods or proof of shipment.

ARTICLE 8 – EXCLUSIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to:

• Customized or made-to-order products

• Products not suitable for return for hygiene reasons

These exclusions are clearly stated in the offer.

ARTICLE 9 – PRICE

Prices remain valid during the stated offer duration unless legal changes apply.

Customs duties and import VAT are borne by the consumer.

ARTICLE 10 – CONFORMITY AND WARRANTY

Tiamo Jewellery warrants that the products comply with the contract.

Defects or incorrect deliveries must be reported within 14 days of receipt.
Products must be returned unused, undamaged, and in original packaging.

Warranty does not cover improper use or unauthorized repairs.

ARTICLE 11 – DELIVERY

Delivery is made to the address provided by the consumer.

Maximum delivery period: 30 days. Consumers will be informed of delays.

Replacement shipments require consumer consent.

Risk of loss or damage passes upon delivery.

ARTICLE 12 – CONTRACTS OF FIXED OR INDEFINITE TERM

Contracts with an indefinite term may be terminated with one month’s notice.

Fixed-term contracts cannot be automatically renewed unless explicitly agreed.

ARTICLE 13 – PAYMENT

Unless otherwise agreed, payments must be made within 7 business days after the withdrawal period begins (Article 6.1).

The consumer must ensure accurate payment information.

In case of non-payment, Tiamo Jewellery may apply reasonable costs after due notice.

ARTICLE 14 – COMPLAINTS

Complaints must be reported within 7 days of discovering a defect.

A response will be provided within 14 days. If more time is needed, the consumer will be notified.

Unresolved disputes may be escalated through a formal procedure.

Seller obligations are not suspended during a complaint unless stated otherwise.

If a complaint is justified, the product will be replaced or repaired at no additional cost.

ARTICLE 15 – DISPUTES

Contracts between the consumer and Tiamo Jewellery are governed exclusively by Hong Kong law, even if the consumer resides outside Hong Kong.
